Terms & Conditions

These terms apply to your use of naturallyhumandesigns.com and to any design, hosting, or care services you buy from Naturally Human Designs ("we", "us"). By using the site or buying a plan, you agree to these terms. If you're buying on behalf of an organisation, you confirm you have authority to bind it; if you're buying as an individual, you confirm you're of legal age.
Who you're contracting with
Services are provided by Naturally Human Designs, operating in the United States. You can reach us at krissie@naturallyhumandesigns.com.
What we provide
Website design and build work, and ongoing hosting and care plans — monitoring, backups, security patching, uptime checks, and (on higher plans) content and improvement time. What's included in each plan is described on the Hosting & Care page at the time you subscribe.
You get a limited, non-exclusive, non-transferable right to use the services within the plan you've selected.
Your account and information
Keep your login credentials confidential — you're responsible for activity under your account. Provide accurate information and keep it up to date so we can reach you about your site.
Acceptable use
You agree not to misuse the services. In particular, you must not:
- use them for anything unlawful, or to send spam or commit fraud;
- infringe anyone's intellectual property or privacy rights;
- interfere with security — uploading malware, probing or scanning systems, scraping, or circumventing technical limits;
- reverse engineer, resell, or redistribute the services.
You're responsible for the content you publish through a site we host, and you grant us a limited licence to host and process that content solely to provide the service. If a rights holder contacts us about your content, we may remove or restrict it; repeated infringement can end the plan.
Intellectual property
We retain ownership of our software, tooling, documentation, and branding. Deliverables specifically produced for you under a design engagement are yours once paid for, as set out in that engagement.
Service level
We work hard to keep sites up and healthy, but we don't guarantee the services will be uninterrupted, error-free, or free of every vulnerability. To the fullest extent permitted by law, we disclaim implied warranties including merchantability and fitness for a particular purpose.
Payment and subscriptions
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Payment, billing, tax, renewal, cancellation, and refund mechanics are governed by Paddle's Buyer Terms. Plans renew automatically each month or year until cancelled. Our own refund window is described in the Refund Policy.
Suspension and termination
We may suspend or end access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. You can cancel at any time through your billing portal; service continues to the end of the paid period.
When a plan ends, we'll provide a reasonable window (normally 30 days) to export your site and data before hosted copies are deleted.
Liability
To the fullest extent permitted by law, we're not liable for indirect, consequential, or special damages, including lost profits, data, or goodwill. Our aggregate liability is capped at the fees you paid in the 12 months before the claim. Nothing here excludes liability for fraud, death, or personal injury where the law does not allow it.
You agree to indemnify us against claims arising from your content, unlawful use, or breach of these terms.
General
You may not assign these terms without our consent; we may assign them in a merger or acquisition. Neither party is liable for delays caused by events beyond reasonable control. These terms are governed by the laws of the United States and the state in which we operate, and disputes will be heard in those courts.
We may update these terms; continued use after an update means you accept the revised version.
